FINMA Guidance 01/2026: Custody of cryptobased assets
FINMA is seeing growing interest in cryptobased assets and associated services in the Swiss financial market. The increased market demand has led to an expansion of services at institutions subject to FINMA’s supervision, in particular banks, securities firms, managers of collective assets and portfolio managers. On January 12, 2026, FINMA published Guidance 01/2026, which addresses the risks associated with the custody of cryptobased assets. The guidance outlines the regulatory requirements, emphasizing the need for robust technical infrastructure and sufficient internal expertise to manage operational risks such as cyber-attacks and inadequate protection of private keys. It also clarifies the responsibilities of financial institutions regarding the custody of cryptobased assets, including the introduction of comprehensive bankruptcy protection for assets held in custody by third parties.

FINMA publishes practical guide to the Berne Financial Services Agreement
Following the Brexit effective 1 February 2020, the UK is considered as a “third country” in regard to the European financial regulations, resulting in the removal of the UK/EU passporting possibilities in regard to financial services and fund offering. The Berne Financial Services Agreement (BFSA) is an agreement between Switzerland and the United Kingdom which was signed in December 2023. Under this treaty, the two countries recognize the equivalence of their respective legal and prudential frameworks in selected financial activities covering notably wealth management, insurance, asset management and financial market infrastructures. It also facilitates cross-border market access between the two countries for Swiss and UK financial service providers. The BFSA will enter into force on 1 January 2026. -

FINMA Risk Monitor 2025: accentuated geopolitical risks – cyber and real estate risks continue to grow
In its 2025 Risk Monitor, FINMA reveals where it sees the greatest risks for the Swiss financial centre. FINMA identifies nine principal risks that it categorises as high. Financial risks include risks in connection with real estate and mortgages, credit risks associated with other loans, credit spread risks as well as liquidity and funding risks. Non-financial risks include risks in the area of combating money laundering, sanctions risks, outsourcing risks, risks resulting from cyberattacks and ICT risks due to the complexity of the systems, software errors and outdated systems.
FINMA also warns of an increase in geopolitical and technological risks and calls for more robust controls over the outsourcing of critical functions. The climate risk report is also part of the Risk Monitor for the first time.
